What is Alimony
Spousal support, also known as spousal maintenance and alimony, is a court-ordered payment, usually monthly, from one person to their former spouse. It is intended to facilitate someone’s reentry into society as a single person with minimal impact on their economic security.
Alimony is often viewed as negative, with claims of the payee being “lazy” or “entitled.” However, there are many instances where some form of alimony may be necessary, such as a mother who elected to stay home to support her children instead of working and building equity. A sudden divorce could leave this mother in a risky situation without any guarantee of economic or financial safety.
Alimony is not guaranteed, even in the example above. If the mother in the example above has some sort of passive income, such as a trust fund, a judge may decide she does not need alimony. Likewise, if there was a valid prenuptial agreement or postnuptial agreement that barred either person from seeking alimony, it is unlikely a judge would go against that agreement.
